What: the Irvine Company is holding a neighborhood meeting to discuss their tree removal and protection plan.

When: 7 p.m., Wednesday, November 28, 2012

I just want to keep you all informed on what Irvine is trying to do, (remove 4 large redwoods in addition to two trees already cut down in front of 401 and 405 River Oaks Parkway.) Mike Bertram our VP of the River Oaks Neighborhood Association and I are making sure San Jose planners are playing fair in North San Jose (and it looks like they are not.) Trees are an important buffer in our neighborhood - they help reduce pollution, noise and help to hide the tall buildings taking over our neighborhood.

Please read what Mike sent to Joe Horwedel, Council Member Kansen Chu, Mayor Reed and City Manager Debra Figone below:

Dear Mr. Horwedel,

Residents along the River Oaks Parkway recently received notice of a Public Hearing regarding the removal of four Redwood Trees along River Oaks. While looking into the details of the proposed tree removal, the River Oaks Neighborhood Association became concerned over what we believe to be an improper approval of a Major Permit Adjustment to permit PD12-007.

Major Permit Adjustment AD12-941 contained changes that would require the removal of four ordnance trees along River Oaks Parkway. Pre-approval correspondence and notes in the permit adjustment file show that Planning Staff knew in advance of the approval that a Public Hearing would be required to approve the removal of the trees. Despite this knowledge, Staff proceeded with the approval of the adjustment without the community outreach required to approve the tree removal. While the tree removal itself was not approved, plan changes requiring the removal of the trees were. Removal of the trees received de facto approval without the required input from the community.

This circumvention of public outreach has disenfranchised the residents of River Oaks Parkway and is a violation of San Jose Council Policy 6-30.

Residents along River Oaks Parkway have made it clear to Planning Staff and City Council that retention of trees is of significant community interest. The River Oaks Neighborhood Association has presented both Planning Staff and each of the individual San Jose Council members with a petition signed by over 200 River Oaks residents indicating retention of trees is a community priority.

We ask that the City not approve PDA12-007-01 at this time and take actions to bring the community back into the decision making process. Before approval of PDA12-007-01, the residents along River Oaks Parkway request that the City host a community meeting in our neighborhood to cover the following issues:

· Rationale for approving AD12-941 in the absence of tree removal approval

· Rationale for the removal of each of the trees in question

· Discussion of alternative options to removing the trees

Irvine is going to have the Tree Removal Hearing scheduled for next week delayed. It will be in January some time. Will let you know far in advance.

In the interim , they will be meeting with the community to provide more information about the specifics regarding each of the four trees with the possibility of approaching the city with alternates to removal.

Thank you all for showing up. It really helped to have neighbors coming out and letting Irvine know we want the redwood trees to stay.
